A note on that last step: we countersign by hand on purpose. A BAA is a binding contract, and we would rather a person read it than have a server sign it automatically.
What the agreement covers
Our BAA follows the HHS model provisions, adapted to a fax service. In plain terms, it commits us to:
- Encrypt your fax documents at rest with AES-256, and in transit with TLS
- Limit access to your PHI to your own authenticated account, with mandatory multi-factor authentication for our administrators
- Report any breach of unsecured PHI to you within ten business days of discovery
- Hold every subcontractor that touches your PHI to the same obligations in writing
- Give you access to, and let you amend, PHI in a designated record set
- Make our practices available to HHS, and return or destroy PHI when the agreement ends
About the signature
Electronic signatures are valid under the federal E-SIGN Act and state Uniform Electronic Transactions Acts. When you sign, we record your name and title, your verified email address, your IP address, and the exact time — and embed a cryptographic hash of the agreement text in the PDF, so it can be shown later that the document was not altered after signing.
You get a copy by email the moment you sign, another when we countersign, and a permanent copy in your account.
